Probate & Letters of Administration

The legal process after the death of a loved one can be complicated and difficult. Probate is the process of registering with the Supreme Court of WA the deceased’s will and appointing an Executor, so they have the legal authority to deal with the deceased’s estate (legal ability to collect and receive assets and pay liabilities). From there the Executor must administer the estate according to the will (unless challenged or otherwise varied by a Deed of Family Arrangement).

Letters of Administration, although similar in applying to the Supreme Court of WA, is the process of administering an estate when the deceased dies without a will and the estate is to be administered under the Administration Act 1903.  This means that the estate does not automatically go to the spouse but is administered in accordance with the table provided under the Administration Act and we recommend you seek legal advice should this scenario apply to you.
